Rentals and Short Term Accommodation
On November 24, 2022, Bill 44, the Building and Strata Statutes Amendment Act, was enacted and became effective immediately removing most rental restrictions in strata buildings in British Columbia.
NOTE: Rental units are living accommodations rented by tenants. Short Term Accommodations are NOT considered Tenancies, they are considered to be License Agreements. See below for more info.
Rentals
All owners are now permitted to rent their units with the following conditions:
- Should an owner rent all or part of a strata lot, that owner must submit a signed Notice of Tenant’s Responsibility (Form K) to the strata corporation within two weeks of renting their unit.
- The Owner will give Council a means (telephone number or email address) for contacting the tenant within two weeks of renting their unit. See Form K Addendum.

Note: download the form to your device prior to filling it out, then save it, sign it and send it to Council.
Landlord’s Insurance
The Strata Corporation recommends that owners who rent their units purchase Landlord’s Insurance. The insurance company will likely want to know what coverage the strata holds in order to give the owner the most complete coverage. For that information, visit: VIS 5801’s Insurance page.
Short Term Accommodation
Under BC law, Short Term Accommodations are considered to be license agreements, not rental agreements.
Vacation accommodations (AirBnB / VRBO type) are NOT permitted in Lighthouse Landing Estates.
LLE Bylaw #45 allows a limited number of 1 – 4 month Short Term Occupancies. For more details on Short Term Accommodation see VIS 5801’s Bylaw 45. A link to our full Bylaws can be found on the Bylaws webpage.

Rental (tenancy) vs License Agreements
The court has said the following regarding tenancies versus licenses:
- A person may occupy a strata lot under a tenancy agreement or a license agreement.
- A tenant is a person who rents all or part of a strata lot and who, through that arrangement, receives an interest in the property including exclusive possession of the premises.
- An occupant is a person other than an owner or tenant who occupies a strata lot.
- A licensee is an occupant but not a tenant.
- Provisions of the Strata Property Act which relate to tenants and tenancies do not apply to licencees.
