In November 2022, British Columbia made changes to the Strata Property Act rendering Bylaws which prevent or restrict rentals unenforceable. Stratas can no longer prohibit or limit rentals.
Therefore, since LLE Bylaw 44 is no longer enforceable, it should be removed from our Bylaws. To that end, our lawyer has drawn up the attached resolution, which will be presented to the owners for a vote at the 2023 AGM. Please review this information, and if you have any questions, let Council know so that we can address any issues prior to the AGM.
In summary, the resolution says that the current bylaw 44, which restricts rentals in Lighthouse Landing Estates, is to be replaced with one that states: if an owner chooses to rent their unit, they must submit a signed Notice of Tenant’s Responsibility (Form K) to the strata corporation within two weeks of renting it. And if they fail to do so, they can be fined $200/week until they do submit the completed form. Bylaws 6 (Inform Strata Corporation) and 33 (Fines) also require minor amendments as they refer to Bylaw 44.
Bylaw 45, which deals with Short Term Accommodation, is not affected. For more information on rentals see our rental webpage: Rentals
